These terms are an agreement between you and [Company legal name], a company registered in India ("New Brain", "we", "us"). They cover trynewbrain.com, the New Brain web, desktop and phone apps, the connection your AI tools use, and the New Brain Card waitlist (together, "New Brain"). By creating an account or using New Brain, you agree to them. If you use New Brain for a company, you agree on its behalf and confirm you're allowed to.
1. Your account
You must be at least 18 to use New Brain. Give us accurate details and keep your sign-in safe; you're responsible for what happens under your account. Tell us straight away at info@trynewbrain.com if you think someone else has used it.
In a company brain, the company's Owners and Admins control who has access, which areas each person and AI tool can use, and what happens to shared areas. Your private area stays private to you.
2. Early access
New Brain is in early access. Features may change, appear or be removed before and after launch, and some, such as the desktop and phone apps and New Brain Card, are not available yet. We'll tell you before we remove a feature you rely on in a paid plan.
3. Your content
You own what you put into New Brain: notes, files, recordings, connected app content and anything else ("your content").
You give us permission to store, copy, process and display your content only as needed to run New Brain for you: for example, to answer your questions, let the AI tools you connect read it, transcribe recordings and make backups. This permission ends when you delete your content, apart from backups, which are cleared within 30 days.
We never use your content to train AI models.
You confirm you have the right to put your content into New Brain, and that doing so doesn't break any law or anyone else's rights.
4. Recording other people
Laws on recording conversations differ by place, and some require everyone's consent. Before you record a meeting, a call or a lecture with New Brain or New Brain Card, you must tell the people involved and have any consent the law requires. You're responsible for that. New Brain shows a recording indicator and asks you to confirm consent, but that doesn't replace your duty to ask.
5. AI tools and apps you connect
When you connect an AI tool (such as ChatGPT, Claude or Cursor) or an app (such as Notion, Google Drive or Gmail), you ask New Brain to exchange data with it. Those services are run by other companies under their own terms and privacy policies. We aren't responsible for what they do, including what an AI tool does with information after it reads it from New Brain. You can disconnect them at any time.
6. Answers can be wrong
New Brain shows the source and date for its answers so you can check them. Answers written by AI, whether by our model or the AI tools you connect, can still be incomplete or wrong. Check important answers against their sources before you rely on them. New Brain is not legal, financial, medical or other professional advice.
7. Acceptable use
Don't use New Brain to:
- break the law or anyone's rights, including privacy and intellectual property;
- record people without the consent the law requires;
- upload malware, or try to break, overload, probe or get around our security or plan limits;
- get into another person's brain or data without permission;
- resell New Brain or build a competing service from it without our written agreement;
- store content that sexually exploits children, promotes violence or harasses others.
We may suspend accounts that break these rules. Where we can, we'll tell you first and give you a chance to fix it.
8. Plans and payment
The free plan is free, within its limits. Paid plans are billed in advance, monthly or yearly, and renew automatically until you cancel. Prices are on the pricing page and don't include taxes, which we add where the law requires.
You can cancel at any time from Settings; your plan stays active until the end of the period you paid for. When a paid plan ends, your brain moves to the free plan's limits and nothing is deleted.
[TODO: refund policy. Suggested: no refunds for partial periods, except where the law requires, or within 14 days of a first yearly payment.]
If we change a price, we'll email you at least 30 days before it applies to you. Plan limits work as described on the pricing page; when you reach one, New Brain tells you and never blocks you from reading or exporting your data.
9. Availability
We work to keep New Brain running, but it may sometimes be unavailable for maintenance or reasons outside our control. Uptime commitments apply only where a Business or Enterprise agreement includes them.
10. New Brain Card waitlist
Joining the waitlist is free and doesn't commit you to buy anything. We haven't set a price or a shipping date, and we may change the design or not ship it at all. Separate terms will apply to any purchase.
11. Ending the agreement
You can stop using New Brain and delete your account at any time. We may end or suspend your access if you seriously or repeatedly break these terms, or if the law requires it. If we end the service for reasons other than your breach, we'll give you at least 30 days' notice to export your data and refund any prepaid fees for the unused period.
After your account is deleted, your data is removed from our systems, backups included, within 30 days.
12. Our responsibility
New Brain is provided "as is". To the extent the law allows, we don't promise that it will always be error-free or meet every need.
To the extent the law allows, neither side is liable to the other for indirect or consequential losses, such as lost profits or lost data that could have been exported, and our total liability for any claim is limited to the greater of the fees you paid us in the 12 months before the claim and US$100. Nothing in these terms limits liability that can't be limited by law.
You agree to cover our reasonable costs if a third party makes a claim against us because of your content or because you broke these terms, including recording someone without consent.
13. Changes to these terms
If we make a significant change, we'll email account holders at least 30 days before it applies. If you keep using New Brain after that, the new terms apply. If you don't agree, you can cancel and export your data.
14. Law and disputes
These terms are governed by the laws of India. The courts of [City], India, have exclusive jurisdiction, except that consumers keep any right to bring a claim in their home country that local law gives them. Before going to court, email us and we'll try to resolve it within 30 days.
